Indecency

There are three levels of indecent. Erotic speach between consenting adults is fully protected by the first amendment.  The right to tell children is NOT protected.  Therefore, text that might be legal between me and my girlfriend is NOT legal when broadcast over CBS.  The government tried to make these same texts illegal over the internet via the Communications Decency Act, but the Supreme Court ruled these provisions unconsitiutional.  By next week congress is expected to pass the "Child Protection Act".  The Supreme Court will likely declare that unconstitutional too.

Obscene speach is not protected, and is illegal almost everywhere.  Generally, the differnece is one of immaturity, force, pain, or excerment.

Grotesque speach is neither protected nor illegal in most places.  But is illegal in some places.  Dan's Gallery of the Grotesque is a famous example of such material.
